In the 2013 shooting death of the president of Gyoza no Ohsho, the Kyoto District Court acquitted defendant Tanaka Yukio (田中幸雄), a yakuza leader. The court also found that the possibility of another perpetrator could not be ruled out regarding the cigarette butt believed to contain DNA evidence.
In December 2013, Daito Takayuki (大東隆行), then president of Osho Food Service, was shot and killed in a parking lot in front of the company’s head office in Yamashina Ward, Kyoto. Defendant Tanaka Yukio (田中幸雄), affiliated with the designated dangerous criminal organization Kudo-kai, was charged with murder and other offenses.
On the 16th, the Kyoto District Court handed down a not-guilty verdict, finding that none of the evidence submitted by prosecutors met the standard for proving the crime. The cigarette butt said to bear the defendant’s DNA profile was likely smoked by the defendant, but the court found it could not rule out the possibility that another perpetrator brought it to the scene or left it there.
The court also found that the other evidence failed to eliminate reasonable doubt that the defendant was the perpetrator, and acquitted him after he had categorically denied the charges.
